ACCC Unfair Contract Terms Report

On 12 November 2016 the unfair contract term regime contained in the Australian Consumer Law and the Australian Securities and Investment Commission Act 2001 (Cth) was extended to protect small business.
The ACCC has sought to give guidance on problematic terms when it published this month a report called 'Unfair terms in small business contacts: A review of selected industries'.
Although there was a focus on certain industries, the general nature of the comments makes it clear that the ACCC's reviews could apply to any standard form contract.
